Here\u2019s a CCPA checklist for publishers who wish to get started with it.<\/em><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>California Consumer Privacy Act (<a href=\"https:\/\/oag.ca.gov\/privacy\/ccpa\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">CCPA<\/a>) was passed in 2018 and is under enforcement action until July 1, 2020. The rules in CCPA are designed to improve user privacy and data protection, much like the EU&#8217;s General Data Protection Regulation (<a href=\"https:\/\/www.adpushup.com\/blog\/gdpr-explainer-an-essential-guide-to-the-new-european-data-protection-laws\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">GDPR<\/a>).<\/p>\n\n\n\n<p>CCPA has done a fine job in defining user data, allowing users to opt-out from sharing it. The law is only applicable to businesses that target California residents\/consumers. <a rel=\"noreferrer noopener\" aria-label=\"It covers a variety of businesses (opens in a new tab)\" href=\"https:\/\/www.adpushup.com\/blog\/california-consumer-privacy-act-ccpa\/\" target=\"_blank\">It covers a variety of businesses<\/a> dealing in user\u2019s data, directly or indirectly.<\/p>\n\n\n\n<p>Non-compliance penalties can range from $2,500 for a non-intentional violation to $7,500 for an intentional violation. Technically speaking, CCPA should impact if you:<\/p>\n\n\n\n<ul><li>Deal in personal information of 50,000 or more California residents<\/li><li>Earn half of your revenue by selling or purchasing consumer information<\/li><li>And\/Or your annual gross revenue is above $25 million<\/li><\/ul>\n\n\n\n<p><strong>Here\u2019s how publishers are impacted:<\/strong> You might not buy\/sell user data directly. However, when you enable user targeting, you share a bunch of information with your advertisers in order for them to show relevant ads. Not limited to that, all the intermedial parties (SSP, <a href=\"https:\/\/www.adpushup.com\/blog\/demand-side-platforms-dsps-how-are-they-evaluated\/\">DSP<\/a>, <a href=\"https:\/\/www.adpushup.com\/blog\/ad-exchange\/\">ad exchange<\/a>) in supply- and demand-chain, get to see\/access the user data. Go Through Your Data Collection Process<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Learn what kinds of platforms you are using for data collection, including Google Analytics, <a href=\"https:\/\/www.adpushup.com\/blog\/adsense-monetization-challenges\/\">AdSense<\/a>, Google Ad Manager, and other third-party services. Partnering up with a CMP should help publishers with CCPA, GDPR, and IAB\u2019s <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.adpushup.com\/blog\/understanding-iabs-transparency-and-consent-framework-tcf\/\" target=\"_blank\">Transparency and Consent Framework<\/a>.<\/p>\n\n\n\n<p>Publishers equipped with technical knowledge can get their hands on building in-house consent management systems. While this will take effort and time, managing consent in-house should save money and make the system more flexible.<\/p>\n\n\n\n<h3 id=\"h-3-make-your-system-ccpa-compliant\"><span class=\"ez-toc-section\" id=\"3_Make_Your_System_CCPA_Compliant\"><\/span>3. Make Your System CCPA Compliant<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>As discussed, Google platforms, like Google Analytics, AdSense, and Ad Manager store user data and now provide options to turn on CCPA compliance.<\/p>\n\n\n\n<p><strong>Steps to make Google Analytics CCPA compliant:<\/strong><\/p>\n\n\n\n<ul><li>Go to <strong>Admin &gt;&gt; CCPA settings<\/strong>.<\/li><li>Choose to <strong>Restrict data processing<\/strong>.<\/li><\/ul>\n\n\n\n<p>By restricting data processing, publishers stop user data to be taken to ad servers for further processing (<a href=\"https:\/\/www.adpushup.com\/blog\/cookie-syncing\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">cookies matching<\/a>, <a href=\"https:\/\/www.adpushup.com\/blog\/audience-segmentation\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">audience segmentation<\/a>).<\/p>\n\n\n\n<p><strong>Steps to Make Prebid CCPA Compliant:<\/strong><\/p>\n\n\n\n<p>In order to make Prebid CCPA compliant, publishers would require a CMP. The CMP provides a piece of consent management code to be placed in Prebid header code. This code fires up every time a <a href=\"https:\/\/www.adpushup.com\/blog\/what-is-prebid-js\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">prebid auction<\/a> runs, asking users permission to store and use their data. Basis of user decision, the auction is further conducted.<\/p>\n\n\n\n<p>Here\u2019s an <a href=\"http:\/\/prebid.org\/dev-docs\/modules\/consentManagementUsp.html\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">example<\/a> of Prebid consent management code:<\/p>\n\n\n\n<pre class=\"wp-block-code\"><code>var pbjs = pbjs || {};\n     pbjs.que = pbjs.que || &#91;];\n     pbjs.que.push(function() {\n       pbjs.setConfig({\n         consentManagement: {\n           gdpr: {\n            cmpApi: 'iab',\n            allowAuctionWithoutConsent: false, \/\/ suppress auctions if there's no GDPR consent string\n            timeout: 3000  \/\/ GDPR timeout 3000ms\n           },\n           usp: {\n            timeout: 100 \/\/ US Privacy timeout 100ms\n           }\n         }\n       });\n     });<\/code><\/pre>\n\n\n\n<p>Similarly, demand partners and advertisers are required to update their systems. When this code starts to run, the demand-side system doesn\u2019t show error executing it.<\/p>\n\n\n\n<h2 id=\"h-how-does-user-opting-out-affect-publishers\"><span class=\"ez-toc-section\" id=\"How_Does_User_%E2%80%98Opting-out_Affect_Publishers\"><\/span>How Does User \u2018Opting-out\u2019 Affect Publishers?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>User opting out doesn\u2019t mean publishers can\u2019t show ads to them. It means that publishers can\u2019t fill in user\u2019s details (<a href=\"https:\/\/www.adpushup.com\/blog\/types-of-cookies\/\">cookies information<\/a>) and share it with advertisers. This will restrict advertisers from showing targeted ads on the publisher&#8217;s website.&nbsp;<\/p>\n\n\n\n<p>In such a case, publishers can take help of <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.adpushup.com\/blog\/types-of-ad-targeting\/\" target=\"_blank\">contextual targeting<\/a> showing ads relevant to their website (niche). And this targeting method does not use cookies or any other personal user data. Similarly, publishers can experiment with a mix of contextual <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.adpushup.com\/blog\/native-advertising-everything-you-ever-wanted-to-know\/\" target=\"_blank\">native advertising<\/a> to serve user-friendly, non-intrusive ads.<\/p>\n\n\n\n<p>Also check: <a rel=\"noreferrer noopener\" href=\"https:\/\/www.adpushup.com\/blog\/california-ag-publishes-revised-version-of-ccpa-regulations\/\" target=\"_blank\">California AG Publishes Revised Version Of CCPA Regulations<\/a><\/p>\n\n\n\n<h2 id=\"h-what-about-publishers-who-are-already-gdpr-compliant\"><span class=\"ez-toc-section\" id=\"What_About_Publishers_Who_Are_Already_GDPR_Compliant\"><\/span>What About Publishers Who Are Already GDPR Compliant?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><em>Then things get easier for them.<\/em><\/p>\n\n\n\n<p>Chances are, GDPR compliant publishers are already using a Consent Management Platform.<\/p>\n\n\n\n<p>Here, it is important to understand the <a href=\"https:\/\/www.adpushup.com\/blog\/ccpa-vs-gdpr-things-to-know-before-ccpa-comes-in-effect-in-2020\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">difference between GDPR and CCPA<\/a>\u2014GDPR asks publishers to tell users about their data usage, while CCPA wants them to ask for consent, whether users want their data to be used or not.<\/p>\n\n\n\n<p>Integrating the existing CMP with CCPA rules won\u2019t be much of a task.<\/p>\n\n\n\n<h2 id=\"h-in-closing\"><span class=\"ez-toc-section\" id=\"In_Closing\"><\/span>In Closing<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As reported by <a href=\"https:\/\/www.washingtonpost.com\/technology\/2020\/01\/21\/ccpa-transparency\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Washington Post<\/a>, companies are really confused\u2014some disclosing too much data, some with too much, and others have incorrect information.<\/p>\n\n\n\n<p>California Attorney General\u2019s office won\u2019t begin enforcement for another six months. This doesn\u2019t mean publishers should wait till the last minute to ensure compliance. The confusion will not get away until you get started with it. The last minute approach risks wrongful implementation resulting in missing out on business from California.<\/p>\n\n\n\n<p>Review your data collection practice keeping the worst-case scenario in mind. Remember, users (consumers) have the right to know about their data usage.
