Here&#8217;s an outline of what it entails.<\/em><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>On August 15, 2020, Brazil is set to enforce its data protection policy titled <em>Lei Geral de Prote\u00e7\u00e3o de Dados Pessoais<\/em> commonly called LGPD. The law was passed on August 14, 2018 followed by official sanctioning by President Bolsonaro in July 2019.&nbsp;<\/p>\n\n\n\n<p>LGPD is closely modeled on the European Union\u2019s GDPR, albeit with some distinct dissimilarities. The official enforcement of LGPD will make organizations responsible for appointing a Data Protection Officer (DPO) who will manage all data processing queries.&nbsp;<\/p>\n\n\n\n<p>In this post, we explain what LGPD is and its similarities with the <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.adpushup.com\/blog\/gdpr-explainer-an-essential-guide-to-the-new-european-data-protection-laws\/\" target=\"_blank\">GDPR<\/a>.<\/p>\n\n\n\n<div id=\"ez-toc-container\" href=\"https:\/\/www.globalizationpartners.com\/2018\/04\/05\/the-internet-in-brazil-today-5-quick-facts\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">66% of Brazil\u2019s<\/a> entire population has access to the Internet and spend about 26 hours a week online. However, these are sectoral laws providing only partial protection to individuals. An all-embracing framework such as the LGPD will help users in all sectors of the economy including both private and personal.&nbsp;<\/p>\n\n\n\n<h2 id=\"h-what-is-a-data-subject\"><span class=\"ez-toc-section\" id=\"What_Is_A_Data_Subject\"><\/span><strong>What Is A Data Subject?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Before we jump into the key features of LGPD, it is important to understand what data subjects are. Though data subjects have already been comprehensively defined in the GDPR, LGPD also explicitly states their definition.&nbsp;<br><\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" width=\"1422\" height=\"574\" src=\"https:\/\/i2.wp.com\/www.adpushup.com\/blog\/wp-content\/uploads\/2020\/02\/Data-Subject-RightsPNG.png?fit=770%2C311&amp;ssl=1\" alt=\"A chart on Data Subject Rights in LGPD\" class=\"wp-image-14533\" srcset=\"https:\/\/www.adpushup.com\/blog\/wp-content\/uploads\/2020\/02\/Data-Subject-RightsPNG.png 1422w, https:\/\/www.adpushup.com\/blog\/wp-content\/uploads\/2020\/02\/Data-Subject-RightsPNG-300x121.png 300w, https:\/\/www.adpushup.com\/blog\/wp-content\/uploads\/2020\/02\/Data-Subject-RightsPNG-1024x413.png 1024w, https:\/\/www.adpushup.com\/blog\/wp-content\/uploads\/2020\/02\/Data-Subject-RightsPNG-768x310.png 768w, https:\/\/www.adpushup.com\/blog\/wp-content\/uploads\/2020\/02\/Data-Subject-RightsPNG-150x61.png 150w\" sizes=\"(max-width: 1422px) 100vw, 1422px\" \/><\/figure>\n\n\n\n<p>Any individual whose data is being collected and\/or processed is a <strong>data subject<\/strong>. <\/p>\n\n\n\n<p>Under LGPD\u2019s Article 18, data subjects are empowered with <strong>nine <\/strong>different rights over their personal data including:&nbsp;<\/p>\n\n\n\n<ul><li>Access to their data<\/li><li>Confirmation of their data\u2019s processing<\/li><li>Rectification of outdated or incorrect data<\/li><li>Anonymize or delete data that is not LGPD-compliant or has been used out of context<\/li><li>Portability: Permission to handover their data to another processor<\/li><li>Deletion of personal data<\/li><li>Disclosure of information about other processors to whom personal data has been shared<\/li><li>Revoking consent on personal data<\/li><li>Information regarding denial of consent and its consequences<\/li><\/ul>\n\n\n\n<h2 id=\"h-key-features-of-the-lgpd\"><span class=\"ez-toc-section\" id=\"Key_Features_Of_The_LGPD\"><\/span><strong>Key Features Of The LGPD&nbsp;<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 id=\"h-who-does-lgpd-apply-to\"><span class=\"ez-toc-section\" id=\"Who_Does_LGPD_Apply_To\"><\/span><strong>Who Does LGPD Apply To&nbsp;<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Similar to the GDPR, LGPD has <strong>extraterritorial application<\/strong>. By this we refer to companies and websites that process data from individuals in Brazil regardless of where they operate from. These companies need to be LGPD-compliant.&nbsp;<\/p>\n\n\n\n<p>Under Article 3, extraterritorial application is further defined as:&nbsp;<\/p>\n\n\n\n<ul><li>Data processing of data collected inside Brazil.<\/li><li>Data processing of individuals in Brazil regardless of the data processor\u2019s location. They can be located anywhere in the world.<\/li><li>Data processing within the territory of Brazil.<\/li><\/ul>\n\n\n\n<p>It is also important to note that LGPD is also <strong>transversal <\/strong>and <strong>multi-sectoral<\/strong>. This means that it will be applied to sectors both private and personal, online and offline.<\/p>\n\n\n\n<h3 id=\"h-how-is-data-defined-under-lgpd\"><span class=\"ez-toc-section\" id=\"How_Is_Data_Defined_Under_LGPD\"><\/span><strong>How Is Data Defined Under LGPD<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>LGPD broadly defines data in three categories. They are:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><td><strong>Type<\/strong><\/td><td><strong>Definition<\/strong><\/td><td><strong>Additional Comments<\/strong><\/td><\/tr><tr><td><strong>Personal<\/strong><\/td><td>\u201cPersonal data is information regarding an identified or identifiable naturalperson.\u201d<\/td><td>LGPD does not explicitly define criteria under personal data. However, it can include name, gender, address, ID numbers, etc.<\/td><\/tr><tr><td><strong>Sensitive<\/strong><\/td><td>\u201cSensitive data is personal data concerning racial or ethnic origin,religious belief, political opinion, trade union or religious, philosophical or politicalorganization membership, data concerning health or sex life, genetic or biometric data,when related to a natural person.\u201d<\/td><td>This is essentially a sub-category of personal data. Under Article 11 of the LGPD, distinct consent is further defined.<\/td><\/tr><tr><td><strong>Anonymized<\/strong><\/td><td>\u201cData related to a data subject who cannot be identified.\u201d<\/td><td>Important to note that if anonymized data can be used in any way for behavioral profiling, it is reversible and does not qualify under this category.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h3 id=\"h-additional-definitions-under-lgpd\"><span class=\"ez-toc-section\" id=\"Additional_Definitions_Under_LGPD\"><\/span><strong>Additional Definitions Under LGPD<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<div class=\"schema-how-to wp-block-yoast-how-to-block\"><p class=\"schema-how-to-description\">Some of the other important definitions under LGPD for getting more clarity are:<\/p> <ol class=\"schema-how-to-steps\"><li class=\"schema-how-to-step\" id=\"how-to-step-1668092534051\"><strong class=\"schema-how-to-step-name\"><strong>Processor:<\/strong><\/strong> <p class=\"schema-how-to-step-text\">Controller (can be a person or a legal entity) who performs operations using personal data.<\/p> <\/li><li class=\"schema-how-to-step\" id=\"how-to-step-1668092554421\"><strong class=\"schema-how-to-step-name\"><strong>Processing:<\/strong><\/strong> <p class=\"schema-how-to-step-text\">Any operation that is carried out with personal data. These operations can include collection, production, receipt, classification, use, access, reproduction, transmission, distribution, and others.<\/p> <\/li><li class=\"schema-how-to-step\" id=\"how-to-step-1668092572095\"><strong class=\"schema-how-to-step-name\"><strong>Controller:<\/strong><\/strong> <p class=\"schema-how-to-step-text\">Any person or legal entity who has the authority to make decisions on processing of personal data.<\/p> <\/li><li class=\"schema-how-to-step\" id=\"how-to-step-1668092585541\"><strong class=\"schema-how-to-step-name\"><strong>Consent:<\/strong><\/strong> <p class=\"schema-how-to-step-text\">Consent is defined as \u2018free, informed and unambiguous manifestation whereby the data subject agrees to her\/his processing of personal data for a given purpose.\u2019<\/p> <\/li><\/ol><\/div>\n\n\n\n<h2 id=\"h-similarities-between-lgpd-and-gdpr\"><span class=\"ez-toc-section\" id=\"Similarities_Between_LGPD_and_GDPR\"><\/span><strong>Similarities Between LGPD and GDPR&nbsp;<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As mentioned above, LGPD is closely modeled on the <a href=\"https:\/\/www.adpushup.com\/blog\/a-gdpr-checklist-for-those-who-are-tired-of-gdpr-checklists\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">GDPR<\/a>, thus also being called Brazil&#8217;s GDPR. Both the frameworks have several similarities including:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><td><strong>Subject<\/strong><\/td><td><strong>Similarities&nbsp;<\/strong><\/td><\/tr><tr><td><strong>Territorial Scope<\/strong><\/td><td>Irrespective of where data processing is taking place, any business or individual processing their personal data within their respective jurisdiction need to be either LGPD or GDPR-compliant according to their region.<\/td><\/tr><tr><td><strong>Data Subject Access Requests<\/strong><\/td><td>Data subjects have the complete right to request access to their data or the right to be forgotten.<\/td><\/tr><tr><td><strong>Appointment Of A Data Protection Officer (DPO)<\/strong><\/td><td>Both LGPD and GDPR require organizations to appoint a DPO if the company:<br>* Is a public entity.<br>* Uses large-scale data processing and monitoring of persons.<br>* Core operations require data processing of unique individuals linked to criminal offenses.&nbsp;<br><br>Despite the necessary criteria, both frameworks still urge organizations not falling under the above categories to appoint a DPO.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 id=\"h-differences-between-lgpd-and-gdpr\"><span class=\"ez-toc-section\" id=\"Differences_Between_LGPD_and_GDPR\"><\/span><strong>Differences Between LGPD and GDPR<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><td><strong>Subject<\/strong><\/td><td><strong>GDPR<\/strong><\/td><td><strong>LGPD<\/strong><\/td><\/tr><tr><td><strong>Legal Bases For Data Processing<\/strong><\/td><td>Companies are subject to <strong>six <\/strong>legal basis under which personal data is processed. These are:<br>Consent, ContractLegal,  Obligation, Vital Interests, Public Task, Legitimate Interests&nbsp;<\/td><td>Companies are subject to <strong>ten<\/strong> legal basis under which personal data is processed.
